By accessing and using The Park Lens ("Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. Service Description

The Park Lens is a platform that connects customers with professional photographers for photography sessions in national parks and natural locations. Our service includes:

  • Online booking and payment processing
  • Photographer matching and coordination
  • Session scheduling and communication tools
  • Photo delivery and gallery services
  • Customer support and dispute resolution

3. User Accounts

Account Creation

You must create an account to book sessions. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Account Termination

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm other users or photographers.

4. Booking and Payment Terms

Booking Process

  • All bookings are subject to photographer availability
  • Prices are clearly displayed before payment
  • A deposit is required to secure your booking
  • Final payment is due 24 hours before your session

Cancellation Policy

  • 48+ hours before session: Full refund
  • 24-48 hours before session: 50% refund
  • Less than 24 hours: No refund (except weather cancellations)
  • Weather cancellations: Full refund or free rescheduling

Pricing and Fees

All prices are in USD and include photographer fees, basic editing, and photo delivery. Additional fees may apply for extended travel, special equipment, or rush delivery.

5. Photographer Services

Photographer Standards

All photographers on our platform are vetted professionals who agree to:

  • Provide professional-quality services
  • Maintain appropriate insurance coverage
  • Follow all park regulations and safety guidelines
  • Deliver edited photos within the agreed timeframe
  • Maintain professional conduct during sessions

Service Delivery

Photographers will deliver professionally edited photos within 7-10 business days via our secure gallery system. The number of photos delivered depends on your session package.

6. User Responsibilities

As a user, you agree to:

  • Arrive on time for scheduled sessions
  • Follow photographer instructions for safety and best results
  • Respect national park rules and regulations
  • Treat photographers with respect and professionalism
  • Pay all fees according to the agreed schedule
  • Provide accurate contact information for coordination

7. Intellectual Property

Photo Rights

Upon full payment, you receive personal usage rights to your photos. This includes printing, sharing on social media, and personal use. Commercial usage requires separate licensing. Photographers retain copyright and may use photos for portfolio purposes with your permission.

Platform Content

All content on our platform, including text, graphics, logos, and software, is owned by The Park Lens or our licensors and is protected by copyright and trademark laws.

8. Limitation of Liability

The Park Lens acts as a platform connecting users with photographers. While we vet our photographers, we are not liable for:

  • Injuries or accidents during photography sessions
  • Weather-related disruptions beyond our control
  • Equipment failure or technical issues
  • Disputes between users and photographers
  • Lost or damaged personal belongings

Our total liability is limited to the amount paid for the specific session in question.

9. Dispute Resolution

We encourage resolving disputes through our customer support team first. If needed:

  • Disputes will be resolved through binding arbitration
  • Arbitration will be conducted in accordance with relevant arbitration rules
  • Users waive the right to participate in class action lawsuits
  • Arbitration location will be convenient to both parties

10. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or park closures.

11. Modifications to Terms

We may update these terms periodically. We'll notify users of significant changes via email or platform notifications. Continued use of our service indicates acceptance of updated terms.

12. Governing Law
